Only the current terms of sale apply to internet sales by somersault18:24 to the user, and this on Belgian territory. All other conditions, even those showing on the user order form, are excluded.

3. FORMATION OF THE INTERNET SALES
The ordering process consists of 3 consecutive steps after the choice has been made and the shopping cart has been validated:

Legal capacity

The prices of the illustrations sold on the website are indicated in euros and the applicable VAT on the date of the order is included in the price.
Any eventual additional costs, such as delivery or shipping fees, are noted on the website.
All prices refer to a single illustration, with the exception of the downloads, which are done through the annual membership.
The annual membership gives the user the right to download, during that year, any illustration showing on the site without additional cost. After this period the membership will be automatically extended for another year. The membership can be cancelled at any time.
All offers are valid only so long as listed on the website.
The prices quoted on the website are subject to change without prior notice.
The prices can not be changed after the customer order has been accepted via the confirmation email, as explained above; the price of purchased items will remain as of the time the order was placed.

6. PAYMENT
somersault18:24. uses a highly secure payment module of FastSpring where the user can pay with most major credit cards as specified below.
Payment is possible via:
1. Credit Card VISA / MASTERCARD / AMERICAN EXPRESS, this payment is free for the user and ensures rapid processing of the order. The payment shall be registered immediately and the order can be shipped immediately.
An audit of the user and his data and the account will be debited on dispatch according to the modalities agreed with your bank.

2. AGEMEENHEDEN EN DEFINITIES
Alleen de huidige verkoopsvoorwaarden zijn van toepassing op de internetverkoop door SOMERSAULT18:24 aan de gebruiker en dit op het grondgebied van België. Alle andere voorwaarden, zelfs die hernomen op de bestelbon van de gebruiker zijn uitgesloten.
SOMERSAULT18:24 kan te allen tijde wijzigingen aanbrengen aan deze algemene verkoopsvoorwaarden. Op lopende contracten blijven echter steeds de voorwaarden gelden die van toepassing waren op het ogenblik van de totstandkoming van de verkoop.

Ondanks dit eigendomsvoorbehoud, gaat het risico wegens verlies of beschadiging over op de klant vanaf dat hij de illustratie in zijn bezit heeft genomen.
5. PRIJZEN EN PRODUCTINFORMATIE
De prijzen van de op de website verkochte illustraties worden aangeduid in euro en de BTW van toepassing op de dag van de bestelling is hierin inbegrepen.
Indien er bijkomende kosten zijn zoals leverings- of verzendingskosten worden deze aangegeven op de website.
Alle prijzen hebben betrekking op één illustratie, met uitzondering van downloads die gedaan worden via het jaarlijks lidmaatschap.
Het jaarlijks lidmaatschap geeft de gebruiker het recht om gedurende dit jaar alle op de website voorkomende illustraties te downloaden zonder bijkomende kosten. Na afloop van deze periode wordt het lidmaatschap automatisch met een jaar verlengd. Het lidmaatschap kan ten alle tijde stopgezet worden.
Alle aanbiedingen gelden zolang zij op de website zijn opgenomen.
De op de website vermelde prijzen kunnen steeds wijzigen.
De prijzen kunnen echter niet meer worden gewijzigd nadat de bestelling van de klant werd geaccepteerd via de bevestigingsemail zoals hierboven uiteengezet, op deze bestelling is de prijs van toepassing van het moment waarop de bestelling werd geplaatst.

SOMERSAULT18:24 verbindt zich ertoe om productinformatie over de illustraties te verschaffen zo duidelijk en correct mogelijk met dien verstande dat de kleuren van de illustratie kunnen variëren van afhankelijk van de instelling van de computer van de gebruiker.
In geen geval kan SOMERSAULT18:24 aansprakelijk worden gesteld voor eventuele verschillen.
Voor bijkomende informatie over de aangeboden illustraties kan er steeds contact worden opgenomen met SOMERSAULT18:24, zoals hieronder verder wordt uiteengezet.
6. BETALING
SOMERSAULT18:24 werkt met een streng beveiligde betalingsmodule van FastSpring waar de gebruiker kan betalen met de meest gangbare creditcards zoals hieronder gespecifieerd.
Betaling is mogelijk via:

Elke klacht en/of vraag wordt serieus behandeld, SOMERSAULT18:24 wenst steeds een oplossing te bewerkstelligen die voor beide partijen bevredigend is.
9. HERROEPINGSRECHT
De gebruiker beschikt over een termijn van 14 volle dagen te rekenen vanaf de ontvangst van de illustratie om zijn herroepingsrecht uit te oefenen zonder een reden te moeten opgeven of zonder een boete te moeten betalen.
Alle illustraties kunnen het voorwerp uitmaken van een terugbetaling behalve diegene waarvan het tegendeel is vermeld, diegene die reeds zijn gebruikt in een presentatie, diegene die zijn gekopieerd door de gebruiker en zeker deze illustraties die op vraag van de gebruiker gepersonaliseerd zijn.
Om een beroep te doen op zijn herroepingsrecht moet de gebruiker absoluut vooraf contact opnemen met SOMERSAULT18:24 om haar de illustratie terug te bezorgen.
SOMERSAULT 18:24 stelt alles in het werk om de gebruiker terug te betalen binnen de 30 dagen vanaf de datum van de ontvangst van de illustratie van de gebruiker.
10. BEWIJS

11. NIETIGHEID
De geldigheid en het naleven van deze algemene verkoopsvoorwaarden zal in geen geval beïnvloed worden door de nietigheid van een van de clausules van deze overeenkomst door een wijziging in de wetgeving, de regelgeving of een gerechtelijke uitspraak.

Any dispute shall be subject to Belgian law, the parties hereto agree that the Court of the Judicial District of LEUVEN have exclusive jurisdiction to handle a dispute between the parties.
By membership, is understood that there is an annual membership starting on the day the user has activated his account by payment.
The user shall receive, annually, an automatically generated email with a link to the payment page, with a request to extend the membership.
Once payment is received, the membership for the current year starts.
There are no refunds if membership is terminated during the current year, in which case the entire annual amount is due.
3. FORMATION OF THE INTERNET SALES
The ordering process consists of 3 consecutive steps after the choice has been made and the shopping cart has been validated:
- The user must identify himself.
- The user must accept the terms and conditions by checking the box provided on the summary page of the order.
- The user must select the payment method and proceed to finalize the payment of his order.
Legal capacity

5. PRICES AND PRODUCT INFORMATION
The prices of the illustrations sold on the website are indicated in euros and the applicable VAT on the date of the order is included in the price.
Any eventual additional costs, such as delivery or shipping fees, are noted on the website.
All prices refer to a single illustration, with the exception of the downloads, which are done through the annual membership.
The annual membership gives the user the right to download, during that year, any illustration showing on the site without additional cost. After this period the membership will be automatically extended for another year. The membership can be cancelled at any time.
All offers are valid only so long as listed on the website.
The prices quoted on the website are subject to change without prior notice.
The prices can not be changed after the customer order has been accepted via the confirmation email, as explained above; the price of purchased items will remain as of the time the order was placed.
No refund can be given to illustrations that after the order has been placed, are offered at lower price by somersault18:24.
somersault18:24 is bound to provide information of the illustrations as clear and accurate as possible, with the understanding that the colors of the illustration may vary depending on the setting of the user’s computer.

6. PAYMENT
somersault18:24. uses a highly secure payment module of FastSpring where the user can pay with most major credit cards as specified below.
Payment is possible via:
1. Credit Card VISA / MASTERCARD / AMERICAN EXPRESS, this payment is free for the user and ensures rapid processing of the order. The payment shall be registered immediately and the order can be shipped immediately.
An audit of the user and his data and the account will be debited on dispatch according to the modalities agreed with your bank.
2. Only ‘custom’ illustrations can also be paid via bank transfer. Any complaint and / or demand is treated seriously, somersault18:24 always wishes to achieve a solution satisfactory to both parties.
9. RIGHT OF WITHDRAWAL
The user has a full period of 14 days from the day he receives the illustration to make use of his right of withdrawal, without giving a reason or without paying a fee.
All illustrations can be subject to a refund except those whose stated otherwise, those that have already been used in a presentation, those that have been copied by the user and certainly illustrations personalized by demand of the user.
To exercise his/her right to appeal, the user must contact somersault18:24 before returning the artwork.
somersault18:24 shall make its best efforts to refund the purchase within 30 days from the date of receipt of the returned illustration.
10. PROOF

11. VOID
The validity and compliance with these terms and conditions shall in no case be affected by the invalidity of any clause of this agreement by a change in legislation, regulation or court decision.
12. PRIVACY POLICY
somersault18:24 uses COOKIES and reserves the right to collect and store information about the user.
The use of cookies is a standard Internet technology that allows certain information to be stored on the server of the user. (file sent by a web server that is stored on the user’s hard disk. It allow a web site to store information on a user’s machine and later retrieve it).

De klant dient steeds de algemene voorwaarden voor internetverkoop te lezen alvorens een internetbestelling te plaatsen. Bij iedere bestelling wordt hem gevraagd uitdrukkelijk te bevestigen dat hij deze voorwaarden aanvaardt, zoniet kan hij de bestelling niet afronden.

2. AGEMEENHEDEN EN DEFINITIES
Alleen de huidige verkoopsvoorwaarden zijn van toepassing op de internetverkoop door SOMERSAULT18:24 aan de gebruiker en dit op het grondgebied van België. Alle andere voorwaarden, zelfs die hernomen op de bestelbon van de gebruiker zijn uitgesloten.
SOMERSAULT18:24 kan te allen tijde wijzigingen aanbrengen aan deze algemene verkoopsvoorwaarden. Op lopende contracten blijven echter steeds de voorwaarden gelden die van toepassing waren op het ogenblik van de totstandkoming van de verkoop.
De overeenkomst met SOMERSAULT18:24 kan gesloten worden in het Nederlands of het Engels naar gelang van de keuze van de gebruiker. Ook de verdere gegevensuitwisseling zal in één van deze beide talen gebeuren.
De gebruiker zal zich niet kunnen beroepen op het feit dat hij de gekozen taal niet voldoende beheerst om de niet-toepasselijkheid van één of meerdere voorwaarden in te roepen.
Elk geschil is onderworpen aan het Belgische recht, enkel de Rechtbank van het gerechtelijk arrondissement LEUVENzijn bevoegd om kennis te nemen van een tussen partijen gerezen geschil.
Onder lidmaatschap wordt een jaarlijks lidmaatschap verstaan ingaande op de dag dat de gebruiker zijn account werd geactiveerd door betaling.
Jaarlijks ontvangt de klant een automatisch gegenereerde email met de vraag om het lidmaatschap te verlengen met in deze email een link die verwijst naar de betalingspagina.
Van zodra de betaling is ontvangen is er opnieuw sprake van een lidmaatschap voor het lopende jaar.
Er gebeuren geen verrekeningen indien het lidmaatschap gedurende het lopende jaar wordt beëindigd, in dat geval is het hele jaarbedrag is verschuldigd.
3. TOTSTANDKOMING VAN DE INTERNETVERKOOP
Het bestelproces bestaat uit 3 opeenvolgende stappen nadat de keuze is gemaakt en het winkelmandje werd gevalideerd:
- de gebruiker moet zich identificeren.
- de gebruiker moet de algemene verkoopsvoorwaarden aanvaarden door het voorziene vakje aan te kruisen op de overzichtspagina van de bestelling.
- de gebruiker moet de betaalwijze kiezen en overgaan tot het betalen van zijn bestelling.
Bekwaamheid
Op het moment van het plaatsen van de bestelling moet de gebruiker meerderjarig zijn en juridisch bekwaam zijn om een overeenkomst te sluiten en in te stemmen met de algemene voorwaarden.
Voor een betaling met een betaalkaart garandeert de gebruiker dat hij ten volle gemachtigd is om die kaart te gebruiken en dat die kaart toegang geeft tot voldoende fondsen om alle kosten te dekken die nodig zijn voor het betalen van de bestelling. Een bedrieglijk gebruik van de website of een gebruik dat een overtreding inhoudt van deze Algemene Voorwaarden kan op elk moment leiden tot de weigering door SOMERSAULT18:24 van toegang tot de bestelde producten of diensten.
Persoonlijke gegevens
Bij de bestelling garandeert de gebruiker dat de gegevens die door hem of door een derde die zijn gegevens gebruikt op de website, oprecht en juist zijn, en aanvaardt hij de gegevens te geven die door hem worden gevraagd:

4. EIGENDOMSOVERDRACHT
Pas bij het ontvangen van de bevestigingsemail ontstaat er tussen de gebruiker en SOMERSAULT18:24 een overeenkomst.
In afwijking van art. 1583 van het Burgerlijk Wetboek blijven de verkochte illustraties de exclusieve eigendom van SOMERSAULT18:24 tot gehele betaling van de factuur.
Ondanks dit eigendomsvoorbehoud, gaat het risico wegens verlies of beschadiging over op de klant vanaf dat hij de illustratie in zijn bezit heeft genomen.
5. PRIJZEN EN PRODUCTINFORMATIE
De prijzen van de op de website verkochte illustraties worden aangeduid in euro en de BTW van toepassing op de dag van de bestelling is hierin inbegrepen.
Indien er bijkomende kosten zijn zoals leverings- of verzendingskosten worden deze aangegeven op de website.
Alle prijzen hebben betrekking op één illustratie, met uitzondering van downloads die gedaan worden via het jaarlijks lidmaatschap.
Het jaarlijks lidmaatschap geeft de gebruiker het recht om gedurende dit jaar alle op de website voorkomende illustraties te downloaden zonder bijkomende kosten. Na afloop van deze periode wordt het lidmaatschap automatisch met een jaar verlengd. Het lidmaatschap kan ten alle tijde stopgezet worden.
Alle aanbiedingen gelden zolang zij op de website zijn opgenomen.
De op de website vermelde prijzen kunnen steeds wijzigen.
De prijzen kunnen echter niet meer worden gewijzigd nadat de bestelling van de klant werd geaccepteerd via de bevestigingsemail zoals hierboven uiteengezet, op deze bestelling is de prijs van toepassing van het moment waarop de bestelling werd geplaatst.
Er kan geen terugbetaling bekomen worden van illustraties die nadat de bestelling werd geplaatst op een later ogenblik aan een lagere prijs worden aangeboden door SOMERSAULT18:24.
SOMERSAULT18:24 verbindt zich ertoe om productinformatie over de illustraties te verschaffen zo duidelijk en correct mogelijk met dien verstande dat de kleuren van de illustratie kunnen variëren van afhankelijk van de instelling van de computer van de gebruiker.
In geen geval kan SOMERSAULT18:24 aansprakelijk worden gesteld voor eventuele verschillen.
Voor bijkomende informatie over de aangeboden illustraties kan er steeds contact worden opgenomen met SOMERSAULT18:24, zoals hieronder verder wordt uiteengezet.
6. BETALING
SOMERSAULT18:24 werkt met een streng beveiligde betalingsmodule van FastSpring waar de gebruiker kan betalen met de meest gangbare creditcards zoals hieronder gespecifieerd.
Betaling is mogelijk via:
1. Kredietkaart VISA/MASTERCARD/AMERICAN EXPRESS, deze betaalwijze is gratis voor de gebruiker en garandeert een snelle afhandeling van de bestelling. De betaling wordt onmiddellijk geregistreerd en de bestelling kan onmiddellijk verzonden worden.
Er wordt een controle uitgevoerd van de gebruiker en zijn gegevens en de rekening zal worden gedebiteerd bij de verzending volgens de met uw bank overeengekomen modaliteiten.
2. Enkel de ‘custom’ illustraties kunnen ook betaald worden via OVERSCHRIJVING. Bij deze betaalwijze zal op de bestelling van de gebruiker een bevestigingsemail volgen met de nodige vermeldingen en het exacte bedrag dat zal moeten worden overgeschreven op het rekeningnummer BE 48 7340 3132 3127 binnen de 14 dagen na het verzenden van de bevestigingsemail.
Let er op dat wanneer u wenst te betalen via een internationale overschrijving, u steeds ook de BIC (SWIFT) en IBAN specificaties die vermeld worden in de bevestigingsemail correct overneemt op uw overschrijvingsbewijs.
Indien u deze vermeldingen niet exact overneemt bestaat de kans dat er extra kosten worden aangerekend voor deze overschrijving waarvoor SOMERSAULT18:24 niet aansprakelijk kan gesteld worden.
Indien de BIC en IBAN specificaties correct worden vermeld is een betaling binnen de Europese Unie gratis.

7. LEVERING
Van zodra de rekening van SOMERSAULT18:24 het correcte en volledige bedrag van de bestelling ontvangt zal de illustratie via een gratis beveiligde download worden overgemaakt aan de gebruiker.
8. CONTACT EN OPMERKINGEN LEVERING
Voor klachten en vragen in verband met de illustraties, de bestelling, de levering of andere aspecten ervan kan de gebruiker steeds een email richten aan info@somersault1824.com.
Elke klacht en/of vraag wordt serieus behandeld, SOMERSAULT18:24 wenst steeds een oplossing te bewerkstelligen die voor beide partijen bevredigend is.
9. HERROEPINGSRECHT
De gebruiker beschikt over een termijn van 14 volle dagen te rekenen vanaf de ontvangst van de illustratie om zijn herroepingsrecht uit te oefenen zonder een reden te moeten opgeven of zonder een boete te moeten betalen.
Alle illustraties kunnen het voorwerp uitmaken van een terugbetaling behalve diegene waarvan het tegendeel is vermeld, diegene die reeds zijn gebruikt in een presentatie, diegene die zijn gekopieerd door de gebruiker en zeker deze illustraties die op vraag van de gebruiker gepersonaliseerd zijn.
Om een beroep te doen op zijn herroepingsrecht moet de gebruiker absoluut vooraf contact opnemen met SOMERSAULT18:24 om haar de illustratie terug te bezorgen.
SOMERSAULT 18:24 stelt alles in het werk om de gebruiker terug te betalen binnen de 30 dagen vanaf de datum van de ontvangst van de illustratie van de gebruiker.
10. BEWIJS
Partijen aanvaarden de elektronische bewijsvoering. (email-backup)
11. NIETIGHEID
De geldigheid en het naleven van deze algemene verkoopsvoorwaarden zal in geen geval beïnvloed worden door de nietigheid van een van de clausules van deze overeenkomst door een wijziging in de wetgeving, de regelgeving of een gerechtelijke uitspraak.
12. PRIVACYBELEID
SOMERSAULT18:24 maakt gebruik van COOKIES en behoudt zich het recht voor om de gegevens over de gebruiker te verwerken en te verzamelen.
Het gebruik van COOKIES is een standaardtechnologie op internet die het mogelijk maakt om bepaalde informatie op te slagen op de server van de gebruiker. (bestand gestuurd door een internetserver dat wordt opgeslagen op de harde schrijf van de computer van de gebruiker. De algemene structuur van deze website en alle elementen ervan, zowel visuele als geluidselementen, met inbegrip van de onderliggende technologie, worden beschermd door de geldende wetgeving op het vlak van intellectuele eigendom, meer bepaald het auteursrecht, de naburige rechten, het merkenrecht, het octrooirecht en het recht op afbeelding. Zij zijn de exclusieve eigendom van SOMERSAULT18:24.
Bijgevolg is de gedeeltelijke of volledige communicatie in het openbaar, gratis of betalend, op welke drager en via welk communicatiemiddel ook, van de elementen die de website uitmaken, zonder akkoord van SOMERSAULT18:24 formeel verboden en dit gebruik zal systematisch worden vervolgd.
